These Terms & Conditions ("Terms") govern your use of The Mental Half mobile application (the "App") and this website. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About the App

The Mental Half is a mental wellbeing app for junior athletes. It provides tools such as mood check-ins, journaling, routines, and insights to support mental wellbeing in sport.

2. Not medical advice

The App is a wellbeing tool, not a medical device or healthcare service. It does not provide medical or psychological advice, diagnosis, or treatment, and it is not a substitute for professional care. If you are experiencing a mental health problem or crisis, please talk to a qualified professional or a trusted adult. In Australia you can contact Lifeline (13 11 14), Kids Helpline (1800 55 1800), or in an emergency, 000.

3. Eligibility and parental consent

• The App is designed for junior athletes and may be used by people under 18.
• If you are under 15 (or under the age of digital consent in your country), a parent or guardian must consent to your use of the App and to these Terms on your behalf.
• Parents and guardians who consent to a child's use of the App agree to these Terms on the child's behalf and are responsible for supervising the child's use.

4. Your account

You are responsible for keeping your login details secure and for all activity on your account. Provide accurate information when creating an account, and tell us promptly at contact@a2zbasketball.com.au if you believe your account has been compromised. We may suspend or close accounts that break these Terms.

5. Your content

You own the content you create in the App (journal entries, check-ins, and similar). You grant us only the limited licence needed to store and display that content back to you and to operate the App's features. We do not use your content for advertising and we do not share it except as described in our Privacy Policy.

6. Acceptable use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to access other users' data or accounts.
• Reverse engineer, copy, or resell the App or any part of it.
• Interfere with the App's operation or security.

7. Intellectual property

The App, website, and all related content (excluding your content), including the name "The Mental Half", logos, design, text, and software, are owned by us or our licensors and protected by intellectual property laws. You may not use them without our permission.

8. Subscriptions and purchases

If the App offers paid features or subscriptions, they are billed through the Apple App Store or Google Play. Prices, billing periods, and free-trial terms are shown at the point of purchase. Subscriptions renew automatically unless cancelled through your App Store or Google Play account settings at least 24 hours before the end of the current period. Refunds are handled by Apple or Google under their respective policies.

9. Availability and changes

We work hard to keep the App available and reliable, but we do not guarantee uninterrupted access. We may update, change, or discontinue features at any time. We may also update these Terms; if we make material changes we will notify you in the App, and continued use after changes take effect constitutes acceptance.

10. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law or other applicable consumer protection laws that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from your use of the App. Where our liability under a consumer guarantee cannot be excluded but can be limited, it is limited to resupplying the service or paying the cost of having it resupplied. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or fraud.

12. Apple and Google terms

These Terms are between you and us, not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide support or maintenance for the App and are not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with the Apple Media Services Terms and the Google Play Terms of Service, as applicable.

13. Termination

You can stop using the App and delete your account at any time. We may suspend or terminate access if you materially breach these Terms. Sections that by their nature should survive termination (such as intellectual property and limitation of liability) will survive.

14. Governing law

These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the Australian courts. This does not affect any mandatory consumer protections that apply in your country of residence.
